1. Definitions

In these Terms, the following definitions apply:

• "Account" means a registered user account that allows access to certain features of the Service.

When you register, you agree to provide accurate, current, and complete information and to update this information to maintain its accuracy. You are responsible for safeguarding your password and for all activities that occur under your Account. You agree to notify us immediately if you suspect any unauthorized use of your Account.

2.2 Age Requirement

You must be at least 18 years old to create an Account and use our Service. By creating an Account, you represent and warrant that you are at least 18 years old.

2.3 One Account Per User

You may not create more than one Account without our express permission. We reserve the right to terminate any duplicate Accounts.

2.4 Account Termination

We reserve the right to suspend or terminate your Account at any time for any reason, including but not limited to violation of these Terms. You may also terminate your Account at any time by contacting our customer service.

3. Content and Intellectual Property

3.1 Our Content

The Service and its original Content (excluding User Content) are and will remain the exclusive property of European Car Insurance Guide and its licensors. The Service is protected by copyright, trademark, and other laws of both Sweden and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of European Car Insurance Guide.

3.2 User Content

When you post, upload, publish, submit, or transmit User Content, you grant us a worldwide, non-exclusive, royalty-free license (with the right to sublicense) to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute such Content in any and all media or distribution methods now known or later developed.

You represent and warrant that:

• You own the User Content or have the right to use it and grant us the rights and license as provided in these Terms
• The posting of your User Content on or through the Service does not violate the privacy rights, publicity rights, copyrights, contract rights, or any other rights of any person

3.3 Content Guidelines

You agree not to post User Content that:

• Is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or discriminatory
• Infringes any patent, trademark, trade secret, copyright, or other intellectual property or other rights of any other person
• Violates the legal rights (including the rights of publicity and privacy) of others or contains any material that could give rise to any civil or criminal liability under applicable laws or regulations
• Promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory, or libelous
• Promotes unauthorized or illegal activities such as copyright infringement or misleading commercial practices
• Contains software viruses or any other code designed to interrupt, destroy, or limit the functionality of any computer software or hardware

3.4 Content Monitoring and Removal

We have the right, but not the obligation, to monitor and edit or remove any User Content provided on the Service. We are not responsible for the User Content posted by users of the Service.

4. Service Usage Terms

4.1 General Use Restrictions

You agree not to use the Service:

• In any way that violates any applicable national or international law or regulation
• To transmit, or procure the sending of, any advertising or promotional material without our prior permission, including any "junk mail", "chain letter", "spam", or any other similar solicitation
• To impersonate or attempt to impersonate European Car Insurance Guide, a European Car Insurance Guide employee, another user, or any other person or entity
• To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Service, or which, as determined by us, may harm European Car Insurance Guide or users of the Service or expose them to liability

4.2 Technical Restrictions

Additionally, you agree not to:

• Use any robot, spider, or other automatic device, process, or means to access the Service for any purpose, including monitoring or copying any of the material on the Service
• Use any manual process to monitor or copy any of the material on the Service or for any other unauthorized purpose without our prior written consent
• Use any device, software, or routine that interferes with the proper working of the Service
• Introduce any viruses, Trojan horses, worms, logic bombs, or other material which is malicious or technologically harmful
• Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Service, the server on which the Service is stored, or any server, computer, or database connected to the Service
• Attack the Service via a denial-of-service attack or a distributed denial-of-service attack
• Otherwise attempt to interfere with the proper working of the Service

5. Paid Services and Payment Terms

5.1 Consulting Services

We offer various consulting services, including personal insurance consultations, claims assistance, and business fleet consulting, which are provided for a fee. Prices for these services are listed on our Service and may change from time to time.

5.2 Payment and Billing

All payments are processed securely through our payment processors. By providing a credit card or other payment method accepted by us, you represent and warrant that:

• You are authorized to use the designated payment method
• The payment information you provide is true and accurate
• You authorize us to charge your payment method for the services you have selected
• You are responsible for any fees or charges your financial institution may impose

5.3 Refunds

Our refund policy varies depending on the service:

• For personal consultations, you may request a full refund up to 48 hours before the scheduled session
• For cancellations less than 48 hours before a scheduled consultation, a 50% cancellation fee applies
• If you are not satisfied with a consultation that has already taken place, please contact us within 7 days to discuss potential partial refunds
• Custom business services are subject to the specific refund terms outlined in your service agreement

Refunds may be issued to the original payment method or as account credit, at our discretion.

5.4 Subscription Services

If you purchase a subscription-based service:

• Your subscription will automatically renew unless you cancel it at least 24 hours before the end of the current billing period
• You may cancel your subscription at any time through your account settings or by contacting our customer support
• No refunds will be provided for partial subscription periods

6. Disclaimers and Limitations

6.1 Service Provided "As Is"

The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without any warranties of any kind, either express or implied. European Car Insurance Guide expressly disclaims all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

6.2 Accuracy of Information

European Car Insurance Guide makes no warranty that:

• The Service will meet your requirements
• The Service will be uninterrupted, timely, secure, or error-free
• The results that may be obtained from the use of the Service will be accurate or reliable
• The quality of any products, services, information, or other material purchased or obtained by you through the Service will meet your expectations
• Any errors in the Service will be corrected

6.3 Not Professional Advice

The information provided through our Service is for general informational purposes only and is not intended as legal, financial, or professional advice. While we strive to provide accurate information, insurance regulations and products vary significantly between countries and may change over time. Always consult with licensed insurance professionals or relevant regulatory authorities for advice specific to your situation.

6.4 Limitation of Liability

In no event shall European Car Insurance Guide, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content
• Any decisions or actions taken or not taken based on information provided through the Service

In any case, our entire liability under any provision of these Terms shall not exceed the amount you paid to European Car Insurance Guide for services during the 3-month period prior to any cause of action arising, or €500, whichever is greater.

7. Indemnification

You agree to defend, indemnify, and hold harmless European Car Insurance Guide, its directors, employees, partners, agents, suppliers, and affiliates, from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms
• Your use of the Service, including, but not limited to, your User Content
• Any use of the Service's content, services, or products other than as expressly authorized in these Terms
• Your violation of any third-party right, including without limitation any intellectual property right, privacy right, or publicity right

8. External Links

The Service may contain links to third-party websites or services that are not owned or controlled by European Car Insurance Guide. European Car Insurance Guide has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

You acknowledge and agree that European Car Insurance Guide shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.

We strongly advise you to read the terms and conditions and privacy policies of any third-party websites or services that you visit.

9. Termination

We may terminate or suspend your Account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your Account, you may simply discontinue using the Service or contact us to request Account deletion.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of Sweden, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

11. Dispute Resolution

Any disputes arising out of or relating to these Terms or the Service shall be resolved through the following process:

1. Informal Negotiation: We encourage you to contact us first to try to resolve any disputes informally.
2. Mediation: If informal resolution is unsuccessful, either party may initiate mediation by a neutral mediator agreed upon by both parties.
3. Arbitration: If mediation is unsuccessful, any unresolved dispute shall be settled by binding arbitration in Stockholm, Sweden, in accordance with the Swedish Arbitration Act.

Notwithstanding the foregoing, each party shall have the right to seek injunctive or other equitable relief in a court of law.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice before any new terms take effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
